Court Dismisses Senator Adeyemi’s Case Against Ododo, APC On Kogi Gubernatorial

A petition that was brought by a contender for the governorship of Kogi on the platform of the All Progressives Congress (APC), Senator Smart Afolabi Adeyemi, against the emergence of the candidate of the party, Usman Ododo, at the most recent primary election of the party has been dismiss

On Wednesday, the court reached the conclusion that the lawsuit did not have sufficient validity and substance to justify granting the requests that were made against Ododo and APC.

Justice James Kolawole Omotosho ruled in the case that was labeled "FHC/CS/556/2023 in Smart Adeyemi v. APC & 2 Ors" that Adeyemi's claims were criminal since he claimed that elections did not take place and that the results that were issued were faked. Omotosho's decision was delivered in the suit that was marked "Smart Adeyemi v. APC & 2 Ors."
He stated that the applicant had an obligation to prove beyond a shadow of a doubt that the claims of forgery and falsification of results were true.

The court stated that it was Senator Adeyemi's responsibility to show the falsified result or the actual results in order to "discharge the burden," and it went on to say that failure to do so "is fatal to the case of the applicant."

As the applicant only produced evidence from his Ward in Ijumu LGA, Justice Omotosho found that the allegation that the election did not take place was likewise not proved, and thus held that this complaint was also not substantiated.

In any event, he stated that the Respondents had refuted the evidence in question and had attached the monitoring reports that were compiled by the Independent National Electoral Commission (INEC), the body that is tasked with the responsibility of monitoring the election.

"In this case, INEC attached its monitoring report and also attached copies of the result, police report confirming the conduct of the election signed by the Commissioner of Police, the case of the Applicant has no basis," he said. Therefore, Justice Omotosho ruled that the lawsuit did not have any value and dismissed it.

In conclusion, he stated, "In the final analysis, having reviewed all of the evidence in this matter, I have no doubt that the APC primary election result held in all of Kogi State's wards on the 14th day of April 2023 and I hold that this is the case."

"The will of a few, such as that of the Applicant, will not be allowed to prevail over the will of the majority in this Honorable Court," the judge said. There is no justification for the Applicant's position. It is dismissed as of this date."
