The Supreme Court issued the judgement Thursday afternoon, May 9, while delivering judgment in an appeal brought by the state's recent governor, Adegboyega Oyetola of the APC, contesting the decision of the Appeal Court that affirmed Adeleke's election.

In its decision, the top circuit's five-member jury, led by Justice Emmanuel Agim, ruled that the board of appeals appropriately restored Adeleke as gubernatorial.

The Independent National Electoral Commission (INEC) proclaimed Adeleke of the Peoples Democratic Party (PDP) the victor of the July 16, 2022 election, stating he received 403,371 votes to unseat Oyetola, who was the governor at the time and received 375,027 votes.

Oyetola and his party claimed discrepancies in the election thus contested Adeleke's triumph in court. On January 27, 2023, the court's majority judge, Justice Tertse Kume, revoked Adeleke's triumph and pronounced Oyetola the winner of the election. Justice Kume ruled that Oyetola received a greater percentage of legitimate voting (314,931) in opposition to Adeleke's 290,266.

Dissatisfied by the verdict, Adeleke as well as the PDP resonated to the Court of Appeal, which overruled the ruling of the tribunal and declared Adeleke the victor of the state gubernatorial poll on March 24, according to news gathered. Oyetola along the APC opposed the outcome of the Appeal Court's decision to the Supreme Court, that recently verified the finding of the Court of Appeal.

According to Channels, a television network that observed the highest court's body's hearing on Monday, the opposing sides presented their motions then explored the judiciary, afterwards the  presiding judge declared Tuesday for decision.

Nevertheless, the two parties, the winning People's Democratic Party (PDP) as well as the coalition partner All Progressive Congress (APC) have expressed optimism that the nation's highest court would decide in their behalf, allowing them to tighten its hold within the South-Western state.
